Brian Dershaw works closely with his clients to identify practical solutions for their legal needs.  Brian represents companies of all sizes, universities, and individuals in the areas of employment, labor, business, and construction law and litigation.  He has also served as counsel in nationwide class actions.  Brian is often able to resolve matters using alternative dispute resolution, including mediation, arbitration, and negotiations.

Brian’s employment law practice includes counseling companies and universities on independent contractor/employee classification, selection, retention, discipline, and termination of employees, and drafting and enforcing covenants not to compete, confidentiality agreements, employment agreements, and separation agreements.  He represents companies in litigation related to classification, wage and hour disputes, sexual harassment, race, age, gender, and disability discrimination, wrongful discharge, retaliation, worker's compensation, and covenants not to compete.  Brian represents management in labor issues related to organization, collective bargaining, fact-finding, arbitration, and strike avoidance and preparation.  Brian also serves as counsel for executives and employees in negotiations and litigation related to employment, noncompete, buy-sell, and separation agreements and in discrimination and wrongful discharge claims. 

Brian assists companies with their day-to-day legal needs with a focus on liability exposure, contract formation and negotiation, and business litigation.  Brian handles construction disputes for owners, architects, general contractors, and subcontractors.  He has argued in the 1st and 12th District Courts of Appeals in Ohio and the United States Court of Appeals for the Sixth Circuit.

Community service is important to Beckman Weil and Brian.  Brian has served on the Board of Trustees for the Peaslee Neighborhood Center since 2004 and served as the Co-Chair from 2008-2010.  He has also been honored by his alma mater as the recipient of the 2008 Capital University Young Alumni Award for his service to the community and profession.  Brian, his wife Michelle, and their two children reside in Mariemont and are active within the community.
